Terms of Service

These Terms of Service ("Terms") govern your use of Make a Meal AI ("the app", "our app", "the service"), operated by Jesse Zuidema, trading as Make a Meal AI, a sole proprietorship registered in the Netherlands under Chamber of Commerce (KvK) number 42026018, located at Nijmegen, the Netherlands ("we", "us", "our").

By creating an account or using Make a Meal AI, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Description of Service

Make a Meal AI is a mobile fitness and nutrition application that uses artificial intelligence to:

• Scan and detect ingredients from photos.
• Generate personalized recipes based on your ingredients, dietary preferences, and fitness goals.
• Track nutrition intake (calories, macronutrients, micronutrients), water consumption, and body weight.
• Log workouts, track progressive overload, and provide training schemas.
• Provide meal plans, shopping lists, and nutrition schemas.
• Scan product barcodes and analyze nutritional quality (NutriScore, NOVA, additives).
• Sync with Apple Health and Google Health Connect (optional).

The app is available on iOS (App Store) and Android (Google Play Store).

2. Eligibility & Account Requirements

• You must be at least 16 years old to create an account and use the app. Users between 16 and 18 should review these Terms with a parent or guardian.
• You must provide a valid, non-disposable email address during registration.
• You must verify your email address before gaining full access to the app.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You may only create one account per person. Creating multiple accounts to circumvent rate limits, subscription restrictions, or bans is a violation of these Terms.
• You must provide accurate profile information. Inaccurate data (height, weight, goals) will result in inaccurate nutritional calculations, for which we bear no responsibility.

3. Subscriptions & Payments

3.1 Subscription Tiers

• Free: Limited to 15 ingredient scans per month and 5 recipe generations per hour. Basic nutrition and workout tracking included.
• Pro ($6.99/month): Unlimited ingredient scans, unlimited recipe generations, barcode scanning, product analysis, and food comparison.
• Pro+ ($14.99/month): All Pro features plus health scanning (NutriScore, NOVA, additives, toxins), meal planning with shopping lists, restaurant finder, nutrition schemas, and advanced training schemas.

3.2 Billing & Renewal

• Subscriptions are billed monthly through the Apple App Store or Google Play Store.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• Your App Store or Play Store account will be charged for renewal within 24 hours prior to the end of the current billing period.
• Prices are in USD and may vary by region due to currency conversion and local taxes applied by Apple or Google.
• We reserve the right to change subscription prices. Existing subscribers will be notified in advance and price changes will take effect at the next renewal.

3.3 Cancellation

• You can cancel your subscription at any time through your device's App Store or Play Store settings.
• Upon cancellation, you retain access to premium features until the end of your current billing period.
• After the billing period ends, your account reverts to the Free tier. Your data (meals, workouts, recipes) is preserved.
• Cancelling your subscription does not delete your account or data.

3.4 Refunds

• All purchases are processed by Apple or Google. Refund requests must be submitted directly to Apple or Google per their respective refund policies.
• We do not process payments directly and cannot issue refunds.

4. Health & Medical Disclaimer

• The app provides general fitness and nutrition information only. It does not provide medical advice, diagnoses, or treatment recommendations.
• AI-generated recipes, meal plans, calorie targets, and nutritional information are estimates and recommendations, not medical prescriptions. They may contain inaccuracies.
• Training schemas and workout suggestions are general fitness guidance. They do not replace advice from a certified personal trainer, physiotherapist, or medical professional.
• Nutritional scores (NutriScore, NOVA classification) are calculated based on available product data and may not be fully accurate.
• Allergies and medical conditions: If you have food allergies, intolerances, medical conditions, or are pregnant or nursing, you MUST consult a qualified healthcare professional before following any AI-generated recipes or nutritional plans. The app does not guarantee the absence of allergens in suggested recipes.
• You use the app's health and nutrition features entirely at your own risk.
• Always seek the advice of a physician, dietitian, or other qualified health provider with any questions regarding a medical condition, diet, or exercise program.
• Never disregard professional medical advice or delay seeking it because of information provided by this app.

5. AI-Generated Content

• Recipes, ingredient detection results, nutritional analyses, and other AI-generated content are produced by third-party AI models (Google Gemini and OpenAI) and may not be 100% accurate, complete, or suitable for your specific needs.
• AI may occasionally misidentify ingredients, suggest incorrect quantities, or produce nutritionally imbalanced recipes.
• You are responsible for reviewing AI-generated content before using it, especially regarding allergens and dietary restrictions.
• We do not guarantee the accuracy, safety, or suitability of any AI-generated content.
• AI-generated recipe images (DALL-E) are artistic representations and may not accurately depict the final dish.

6. Acceptable Use

You agree to use Make a Meal AI only for its intended purpose (personal fitness and nutrition tracking) and not to:

• Use the app for any illegal, harmful, or unauthorized purpose.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise extract the source code of the app.
• Attempt to access, exploit, or abuse the app's API, backend systems, or edge functions.
• Circumvent or attempt to circumvent rate limits, subscription restrictions, bot protection, or other security measures.
• Create multiple accounts to evade restrictions or bans.
• Upload inappropriate, offensive, illegal, or non-food-related images.
• Use automated tools, scripts, bots, or scrapers to access or interact with the app.
• Interfere with or disrupt the app's infrastructure, servers, or other users' experience.
• Impersonate another person or misrepresent your affiliation.
• Use the app to generate content for commercial purposes without our written permission.
• Redistribute, sublicense, or commercially exploit AI-generated recipes, images, or other app content.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. Intellectual Property

7.1 Our Intellectual Property

The app — including its design, source code, branding, logos, icons, user interface, algorithms, edge functions, database schemas, and documentation — is owned by Jesse Zuidema, trading as Make a Meal AI and is protected by copyright and other intellectual property laws. All rights not explicitly granted to you are reserved.

You may not copy, modify, distribute, sell, or create derivative works based on the app or any part of it without our prior written consent.

7.2 Your Content

You retain ownership of content you create or upload, including:

• Photos you take or select for scanning.
• Meals and workouts you log.
• Profile information you provide.

By uploading content to the app, you grant us a limited, non-exclusive, worldwide license to store, process, and display that content solely for the purpose of providing the app's services to you. This license ends when you delete the content or your account.

7.3 AI-Generated Content

Recipes, meal plans, and images generated by AI through the app are provided for your personal, non-commercial use. You may:

• Use AI-generated recipes for personal cooking and meal preparation.
• Share individual recipes with friends and family for personal use.

You may not:

• Commercially publish, sell, or redistribute AI-generated recipes or images as your own work.
• Use AI-generated content to create competing products or services.
• Claim exclusive ownership or copyright over AI-generated content.

AI-generated content may be similar to content generated for other users, as it is produced by general-purpose AI models.

7.4 Recipe Database

The app includes a curated database of pre-built recipes. These recipes are our intellectual property and may not be copied, extracted, or redistributed in bulk.

7.5 Third-Party Intellectual Property

The app uses third-party data sources (Open Food Facts, FatSecret) for nutritional information. This data is used under their respective licenses and terms. Trademarks of third-party products and brands belong to their respective owners.

8. User-Generated Content (Community Features)

If and when community features (posts, shared recipes, likes) are made available:

• You are solely responsible for any content you post.
• You may not post content that is illegal, offensive, defamatory, infringing, or harmful.
• By posting content, you grant us a non-exclusive, royalty-free, worldwide license to display and distribute your content within the app.
• We reserve the right to remove any content that violates these Terms without notice.
• We are not responsible for content posted by other users.

9. Account Suspension & Termination

• We reserve the right to suspend or terminate your account, without prior notice, if you violate these Terms, engage in abusive behavior, or if we reasonably believe your account has been compromised.
• Grounds for suspension or termination include, but are not limited to: creating multiple accounts, circumventing rate limits, uploading inappropriate content, attempting to exploit the app, or engaging in fraud.
• You may delete your account at any time from Profile > Delete Account. This permanently removes all your data (see our Privacy Policy for details).
• Upon termination, your license to use the app is immediately revoked. Any active subscription continues until the end of the current billing period but will not renew.

10. Limitation of Liability

• Make a Meal AI is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
• We do not warrant that the app will be uninterrupted, error-free, secure, or free of bugs or viruses.
• We do not warrant the accuracy, completeness, or reliability of any AI-generated content, nutritional information, training recommendations, or product analyses.
• We are not liable for:
  • Any adverse health effects, allergic reactions, injuries, or damages resulting from following AI-generated recipes, meal plans, nutritional advice, or workout recommendations.
  • Inaccurate ingredient detection, incorrect calorie calculations, or nutritional data errors.
  • Loss of data due to account deletion, technical failures, or service interruptions.
  • Actions of third-party services (Supabase, OpenAI, Google, RevenueCat, Apple, Google Play).
  • Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• Our total aggregate liability to you for any claims arising from or related to the app shall not exceed the amount you paid for the app in the 12 months preceding the claim, or EUR 100, whichever is greater.
• Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jesse Zuidema, trading as Make a Meal AI, its owner, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the app or violation of these Terms.
• Content you upload or share through the app.
• Your violation of any third-party rights, including intellectual property rights.
• Any claim by a third party related to your use of AI-generated content.

12. Service Availability & Modifications

• We strive to keep the app available at all times but do not guarantee uninterrupted access. The app may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, update, or discontinue any feature of the app at any time. If we discontinue a paid feature that is core to your subscription tier, we will provide reasonable notice and, where appropriate, adjust your subscription.
• We may update the app to fix bugs, improve performance, or add features. Updates may be delivered automatically through the App Store or Play Store.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications outages, cyberattacks, third-party service outages (Supabase, OpenAI, Google, Apple, Google Play), or other force majeure events.

14. Governing Law & Jurisdiction

• These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
• Any disputes arising from or related to these Terms or the use of the app shall be submitted to the competent court in Gelderland, the Netherlands.
• If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights granted by the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
• European consumers may also submit complaints to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

15. Dispute Resolution

In the event of a dispute, we encourage you to first contact us at support@makeamealai.com so we can attempt to resolve the issue informally. We commit to responding within 14 business days.

If an informal resolution is not possible, disputes shall be resolved through the competent courts as specified in Section 14.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jesse Zuidema, trading as Make a Meal AI regarding your use of Make a Meal AI. These Terms supersede any prior agreements, representations, or understandings relating to the app.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision is only effective if made in writing and signed by us.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in connection with a merger, acquisition, or sale of assets, provided that the successor agrees to be bound by these Terms.

20. Changes to These Terms

• We may update these Terms from time to time. The "Last updated" date at the top will be revised.
• For material changes (changes to pricing, liability, your rights), we will notify you via in-app notification or email at least 30 days before the changes take effect.
• For material changes, we will ask for your active acceptance (e.g., a confirmation prompt in the app) before the new terms apply.
• If you do not accept the updated Terms, you may stop using the app and delete your account. Continued use of the app after actively accepting updated Terms constitutes your agreement to the revised Terms.
